Let me just say...I was laid off last week...because of a co-worker for the last year plus has been intimidating me. I have NO doubt that this was the reason I was let go. My HR director will not give me the evidence/emails from him because it is now "Quaker" evidence. Meaning the place I used to work at. Would I do anything different...NO...BUT, be prepared to LOSE your job. I never thought I would be let go and didn't print off the evidence ahead of time. I was stupid....I would get a lawyer, but that will cost money...something I do NOT have right now.

Seriously...this person is demented...I am/was afraid for my safety....and I was the one let go for making waves.

JUST understand what you are getting yourself into. The company will want to CYA more than anything. If you feel that you are morally and ethically right, then go to HR...BUT, be prepared for the worse.

Thats quiet a interesting situation you have there, I am not 100% how the law works in the USA but I do know how it works in New Zealand and it will be similar.

The main issue that you face is that the manager cannot be held responsible by the courts, this is because he is only doing his job. Such things as corporate personality will protect employees, shareholders etc from being held accountable for their own actions so long as they are carrying out their normal course of work in the process (This doesn't cover things such as fraud). So what I suggest, although it might seem strange to you, is to sue the actual company itself. Assuming you have complaind in the past and have records of it, if the company has done nothing to change the situation they have given him authority to treat you in such a manner. Which would make them liable for verbal assualt, slander, maybe a preach of constitutional rights and hell its America so maybe even emotional damages if you really wanted.

By the sounds of things that have happened, they realise this lol.

I know discussing labor unions, is a topic that is often alot less then popular.

However, I know that where I work, a unionized job, we have a very strict anti harassment policy, and if anyone, including management did what E's boss did, there would be a grievance filed, and most likely the individual would be terminated.

I hope things continue to get better....

It really meant a lot to me.

I would have posted sooner, but I've been dealing with bullshit with the ex, and didn't have time or energy.

As for when I started this thread, I was a wreck

The weekend before I went in, I canceled Valentine's Day,

I was an angry jerk to bean water,

I barely ate,

I got no sleep,

and I would randomly rant in my head at him.

Then on Monday morning, I was so nervous when I walked into the HR woman's office, I was shaking like a meth addict on a three-day bender with nothing but Jolt and Espresso to drink.

I calmed down a bit, and gave her the letter I wrote.

Then I left her office and got so nauseous I almost threw up.

But it was worth it :)

They took it very seriously. Especially the anti-semitic joke, which quite honestly didn't bother me nearly as much

as the death threats and every day intimidation.

This moved VERY fast.

From there it went to the general manager and by the time the day was out, everyone in my department

got interviewed.

They determined that I'm a bit of a pain in the ass who doesn't follow directions, but that I'm better in my position than anyone before me (which is a joke since I make no fucking money) and that my manager needs to chill the hell out and not scare the shit out of me every day.

Since then, I've been more respectful of the fact that when he asks to do something, it's in fact an order, and one that needs to be done five minutes ago, and not two hours later at my leisure since I have other things to finish up first, as was sometimes the case.

As for him: he actually listens to me now. He was a bit of a resentful prick in the first few days.

Day one, he wouldn't look at me.

Day two, he bitched at me for turning him in.

Day three, he would make a point of constructive criticism and then say "Oh I shouldn't say that should I. You are amazing eternal, and I am so happy that you even came to work and tried that."

Day four, we were cool.

Last month sucked performance-wise, and we get paid on performance, so last month I got paid $6/hr.

But, things are already looking better this month, and he even complimented me.

This whole experience taught me that no matter how shitty this economy is, no one deserves to be treated like dogshit.

Of course, my ex did it for over a decade,soI don't have the best track record in these matters.

Now, I'm just hoping the future will be good (financially) for both of us.

Because if I put in another month-full of 55/hr weeks for sub-minimum wage,

I'm looking elsewhere, whether he kicks my ass or kisses it.
