Why is Kylo Ren a Sith?

He isn't a Sith.

When Darth Vader killed Darth Sidious the Darth Bane's Sith line of master and the apprentice was broken since both master and apprentice died basically at the same time.

Kylo isn't a Sith. He us "just" a Dark Jedi and a member of the Knights of Ren. We don't know whether the Knight of Ren are all dark side users and we don't know who or what is Snoke.

But Kylo isn't a Sith and J.J. Abrams said so himself.

He was never given a Sith name/title (usually Darth ____ ). The name/title is usually bestowed upon an apprentice by their master (as seen in Revenge of the Sith between Palpatine and Anakin), going all the way back to Bane and his apprentice.

 

Story Time: So, way back (thousands of years before Battle of Yavin), there was an actual Sith Empire that warred with the Republic. Within the Sith Empire, you have the Emperor then a Dark Council (made of up to 12 Sith), then a bunch of Sith vying for power and a seat on the council. 

 

Because of the infighting, it made it easy for the Jedi at the time to essentially wipe out the Sith Empire; leaving Bane and his apprentice. It's now that he enacts the "Rule of Two" ("Always two there are," Yoda says. "No more, no less. A master and an apprentice.") So, the Rule of Two works for a thousand years and more until the Battle of Endor where both Palpatine and Vader die. The former at the latter's hands; and the latter from the Force lightning. 

 

So, Kylo Ren was not a Sith. Just a guy twisted into wanting to follow the footsteps of his grandfather.

 

And yes, there are others who use the Dark SIde, but they're not Sith. One character that stands out in the now defunked EU since Disney bought the whole of Star Wars is Mara Jade. She used the Dark Side, trained under Palpatine, but never received the Darth title and name.

But what if the emperor didn't really fully die and is just another force ghost?  He could just go make another Darth.

Though I think they should have highlighted that the Sith were dead a bit more if that's how they wanted to play it.

I don't know, the way it's all played out makes me want to hit them all with my stick.
